ARBITRATION

Arbitration 1Pursuant to certain contracts entered into by our individual and corporate clients, many disputes today must be resolved through some form of alternative dispute resolution (“ADR”), such as binding arbitration before the American Arbitration Association (“AAA”), National Association of Security Dealers (“NASD”), New York Stock Exchange (“NYSE”), as well as the Society of Maritime Arbitrators (“SMA”) and other forms of ad-hoc ADR.  This firm has experience with all of these types of arbitration, as well as international arbitration governed by entities such as International Chamber of Commerce (“ICC”) Court of Arbitration.

Arbitration 2Having the right counsel can make the difference between a successful prosecution or defense in arbitration.  Typically, one party is quite recalcitrant in honoring its obligations pursuant to the contract’s arbitration clause.  This firm is skilled at compelling a party to proceed with arbitration and taking the necessary steps to enforce an arbitration panel’s award.

We also regularly advise our clients as to the drafting of an appropriate arbitration clause to provide maximum protection during contract negotiations.
